Regulation (EU) 2023/1115 of the European Parliament and of the Council of May 31, 2023, regulates (art. 1) the marketing on the Union market and the export from the Union of certain raw materials and products associated with the deforestation and forest degradation such as: cattle, cocoa, coffee, oil palm, rubber, soybeans and wood. In the same article the objectives are expressed: a) to minimize the Union's contribution to deforestation and forest degradation throughout the world and thus contribute to reducing global deforestation; and b) reduce the Union's contribution to greenhouse gas emissions and global biodiversity loss. This Regulation was the subject of various criticisms and assessments, e.g. Within the framework of the Trade and Environment Committee of the World Trade Organization (WTO), different countries issued a Communication (2023) where they expressed their concern regarding the existence of many aspects of European regulation that are not clear or that require a complementary regulation; Therefore, the effective period that operators and all agents that are part of these chains will have to implement the necessary adjustments for compliance will be much shorter than the period of 18 months established in the standard for its implementation. Likewise, the countries will have, in principle, a unilateral rating on the level of deforestation risk, whose specific criteria and methodology have not been communicated or coordinated with the potential affected countries, among others. For its part, the EU stated that the Regulation does not imply an extraterritorial application of measures, given that compliance with said regulation is only required for products that are intended to be "made available on the Union market." For others, this is a rule against “imported deforestation”. |

El Reglamento (UE) 2023/1115 del Parlamento Europeo y del Consejo del 31 de mayo de 2023, regula (art. 1) la comercialización en el mercado de la Unión y a la exportación desde la Unión de determinadas materias primas y productos asociados a la deforestación y la degradación forestales tales como: ganado bovino, cacao, café, palma aceitera, caucho, soja y madera. En el mismo artículo se expresan como fines: a) reducir al mínimo la contribución de la Unión a la deforestación y la degradación forestal en todo el mundo y así contribuir a reducir la deforestación mundial; y b) reducir la contribución de la Unión a las emisiones de gases de efecto invernadero y a la pérdida de biodiversidad mundial. Este Reglamento fue objeto de distintas críticas y apreciaciones, v.g. en el marco del Comité de Comercio y Medio Ambiente de la Organización Mundial del Comercio (OMC), distintos países emitieron una Comunicación (2023) donde expresaron su preocupación respecto a la existencia de muchos aspectos de la regulación europea que no están claros o que requieren una reglamentación complementaria; por lo que el plazo efectivo que tendrán los operadores y todos los agentes que forman parte de estas cadenas para implementar las adecuaciones necesarias para su cumplimiento, será mucho menor al plazo de 18 meses establecido en la norma para su implementación. Asimismo, los países contarán, en principio, con una calificación unilateral sobre el nivel de riesgo de deforestación, cuyos criterios específicos y metodología no han sido comunicados ni coordinados con los potenciales países afectados, entre otros. Por su parte, la UE manifestó que el Reglamento no implica una aplicación extraterritorial de medidas, dado que sólo se exige el cumplimiento de dicho reglamento a los productos que se pretendan "hacer disponible en el mercado de la Unión". Para otros, esta es una norma contra la “deforestación importada”.
