Through a legal-comparative and documentary study of Latin American countries, it is evident that its recognition faces conceptual and legal barriers, particularly regarding the restrictive interpretation of “intentional act” and the “causal link.” However, progress can be seen in regulatory frameworks that incorporate technical and expert criteria—such as psychological autopsy—to reconstruct the work context in cases of suspicious deaths. In turn, it is possible to complement these preventive tools with psychosocial assessment questionnaires used by different countries. In line with the empirical evidence, it is proposed that this type of suicide is a multicausal phenomenon that must be addressed from a structural rather than an individualistic perspective. It is proposed to move toward an occupational health policy that not only mitigates risk factors but also strengthens compensation mechanisms and raises awareness of the issue. Finally, the article concludes with proposals for more robust regulation focused on prevention and social justice. El suicidio relacionado con el trabajo es una problemática urgente dentro del campo de los riesgos psicosociales, debido a su relación con condiciones laborales adversas como el acoso, la sobrecarga, la precariedad organizacional, entre otras. Mediante un estudio jurídico-comparado y documental de países latinoamericanos, se evidencia que su reconocimiento enfrenta barreras conceptuales y legales, especialmente en la interpretación restrictiva del “acto intencional”, así como también del “nexo causal”. Sin embargo, se observan avances en marcos normativos como el que incorporan criterios técnicos y periciales –como es la autopsia psicológica– para reconstruir el contexto laboral en muertes que son dudosas. A su vez, es posible complementar estas herramientas preventivas con los cuestionarios de evaluación psicosocial aplicados por diferentes países. En consonancia con la evidencia empírica, se plantea que este tipo de suicidio es un fenómeno multicausal, que debe ser abordado desde una perspectiva estructural más que individualista. Se propone, de este modo, avanzar hacia una política de salud laboral que no sólo mitigue los factores de riesgo, sino que también fortalezca los mecanismos de compensación, al igual que la visibilización de la problemática. Por último, se concluye con propuestas para una regulación más robusta, centrada en la prevención y la justicia social. Centro de Estudio Sociales.
