The different and multiple ways of kinship today (paternal/maternal ties) through the family structures that exist in these times highlight the historicism of the term family, undermining the traditional idea that was held about it. Assisted human reproduction techniques and certain adoptions involve factual situations and legal effects that sometimes require setting aside the provision in the last paragraph of Article 558 of the National Civil and Commercial Code. However, it would not be appropriate to declare the unconstitutionality of that provision contained in the invoked body of law. Cases of multiple parenthood may be resolved in light of Articles 1 and 2 of the NC&CC when the best interests of the child so warrant. La exigencia normativa de que una persona no puede tener más de dos vínculos filiales contradice, en casos particulares, principios fundamentales e ínsitos a toda persona como el derecho a la identidad, cuya protección se refleja en nuestra Constitución Nacional como derecho humano primordial; como así también en las disposiciones de la Convención Americana de Derechos Humanos y la Convención de los Derechos del Niño, internalizadas en nuestra Carta Magna. Las diferentes y múltiples maneras de emparentamiento actual (vínculos paternos/maternos) a través de las conformaciones familiares que existen en estos tiempos reseñan el historicismo del vocablo familia, desvirtuando la idea tradicional que se tenía de ella. Las técnicas de reproducción humana asistida y ciertas adopciones, entre otras, importan situaciones fácticas y efectos jurídicos propios que conllevan, en ocasiones, dejar de lado la disposición normativa del último párrafo del artículo 558 del Código Civil y Comercial de la Nación. No obstante, no sería pertinente declarar la inconstitucionalidad de dicha ordenación contenida en el cuerpo normativo invocado. Los casos de pluriparentalidad que correspondan pueden ser resueltos a la luz de los artículos 1º y 2º del CCyCN cuando el interés superior del menor lo amerite.
