The sentence, beyond condemning the province to repair the damage caused by the lack of prevention tasks, sets useful parameters to determine the existence of lack of service in cases of omission: the nature of the due state activity, the means available to the service, the link between the victim and the service and the degree of foreseeability of the damage. En este artículo se analiza un reciente fallo de la Corte Suprema de Justicia de la Nación, en el que el tribunal examina los recaudos para hacer efectiva la responsabilidad del Estado. La sentencia, más allá de la condena a la provincia a reparar los daños causados por la falta de tareas de prevención, fija parámetros útiles para determinar la existencia de falta de servicio en los casos de omisión: la naturaleza de la actividad estatal debida, los medios de que disponía el servicio, el lazo que unía a la víctima con el servicio y el grado de previsibilidad del daño.
