The purpose is to cross-check the analysis carried out by Derrida of works of\nauthors like Pascal, Montaigne, Walter Benjamin, Kafka, against the current questions\nof legal philosophy, such as the (merely conjectural, hypothetical, presupposed) base\nfor Kelsen?s basic norm (Grundnorm) or the relationship between Law and Morality,\nLaw and Justice, and Law and violence. The key focus on which the author concentrates\nis questioning the concept of violence. He attempts to define who, and why and\nhow, holds ultimate power: the power to proclaim what violent is and is not. ?What\nis the difference between force of law and the mere violence deemed unfair?? El\nfundamento místico de la autoridad, en el cual el autor analiza, como indica el título\ndel ensayo, los fundamentos (narraciones, e ideas) en que se basa la autoridad del\nDerecho. Se busca cruzar el análisis que lleva adelante Derrida de las obras de autores\ncomo Pascal, Montaigne, Walter Benjamin, Kafka, con las preguntas actuales de la\nfilosofía legal, como ser el basamento (meramente conjetural, hipotético, presupuesto)\nde la norma fundamental de Kelsen o la vinculación entre el Derecho y la Moral, el\nDerecho y la Justicia, el Derecho y la violencia. El punto central a que se dedica el\nautor es interrogar el concepto de violencia. Trata de precisar quién, por qué y cómo\ndetenta el máximo poder: el poder de nombrar qué es lo que es violento. Y qué es lo\nque no. ?¿Que diferencia hay entre la fuerza de la ley y la mera violencia que consideramos\ninjusta??
