This paper aims to briefly demonstrate that the human rights protection bodies at the American level have at their disposal several tools to develop a truly pluricultural interpretation in environmental matters, as well as the power to recognize the ownership of the right to a healthy environment to Nature itself, as a subject. To this end, I will analyze some of the greening practices of international law, as well as the doctrine of "good living", typical of Latin American indigenous communities. In addition, I will address different philosophical and juridical foundations to justify the viability of the hypothesis. Finally, I will conclude that it is indeed possible for the Inter-American human rights system to set aside the anthropocentric approach to the right to a healthy environment and adopt a "biocentric" conception. In this respect, human beings would abandon our character as the sole subjects of this right, in favor of Nature itself, as an entity of which we only form a small part

Buenos Aires, Argentina America Latina Zorzin, Natalia Danae 2021 Este trabajo obtuvo el primer puesto en el XVIII Concurso de Ensayos "Dr. Ignacio Winizky" sobre Derecho Ambiental. -- El derecho humano a un ambiente sano se fue construyendo en torno a un paradigma tradicional, que desconoce el desarrollo de la naturaleza como sujeto de derechos, propio de las culturas de los pueblos indígenas y comunidades tribales alrededor del mundo, pero especialmente en Latinoamérica. El presente trabajo pretende demostrar de manera concisa que los órganos de protección de derechos humanos a nivel americano tienen a su alcance numerosas herramientas para desarrollar una interpretación verdaderamente pluricultural en materia ambiental, así como la potestad de reconocer la titularidad del derecho a un ambiente sano a la naturaleza misma, en su carácter de sujeto. Para ello, analizaré algunas prácticas de reverdecimiento del derecho internacional y la doctrina del buen vivir, propia de las comunidades indígenas latinoamericanas. Abordaré, asimismo, distintas fundamentaciones filosóficas y jurídicas para justificar la viabilidad de la hipótesis. Para finalizar, concluiré que, efectivamente, resulta posible que el sistema interamericano de derechos humanos deje de lado el enfoque antropocéntrico del derecho al ambiente sano y adopte una concepción "biocéntrica".
