El Comité de Derechos Humanos (Comité DH), la Corte Interamericana de Derechos Humanos (Corte IDH), el Tribunal Europeo de Derechos Humanos (TEDH) y el Tribunal de Justicia de la Unión Europea (TJUE), en su jurisprudencia se han referido a los criterios y alcances que se vinculan al derecho a la defensa penal.
