En este contexto, se examina críticamente la orientación jurisprudencial más reciente que admite tal relevancia, en contraste, sin embargo, con la lectura tradicional de la prescripción como fundada en la necesidad de seguridad de las relaciones jurídicas. El artículo trata sobre la influencia de los hechos en el curso de la prescripción en el derecho italiano, con especial atención a la acción de daños y considerando particularmente el conocimiento por parte de la víctima de los elementos constitutivos del ilícito.
