Entre las consideraciones que realiza el Tribunal, las más\ndestacadas (y potencialmente controversiales) se refieren al rol del Poder Judicial en la\nefectivización de los derechos sociales.\nMi intención en este trabajo es evaluar la postura del TSJ a la luz de la concepción\ndeliberativa de la democracia. Para ello será necesario considerar las eventuales similitudes\ny diferencias entre los derechos civiles y políticos (DCP) y los derechos\neconómicos, sociales y culturales (DESC). Este análisis conducirá, en última instancia,\na un problema de suma relevancia en la teoría de la democracia, a saber, la paradoja\nde las precondiciones de la democracia.
