La determinación de los vínculos paternos y maternos no es una cuestión cuantitativa sino cualitativa, dentro de cada fuente de la Filiación. En ese marco, la regla del doble vínculo obligatorio es incorrecta. En la Filiación por naturaleza, los vínculos son necesariamente dos, pues están determinados por la generación a partir del acto intersexual. En la Filiación por voluntad procreacional, los vínculos están limitados a aquellos que expresaron su consentimiento previo; esta limitación atenta contra el derecho a la identidad y debe ser suprimida. En la Filiación adoptiva, la pluriparentalidad es posible porque se basa en el reconocimiento del origen que precede a la adopción. El interés superior del hijo niño no altera las reglas de determinación de los vínculos con sus progenitores, aunque es relevante para establecer sus funciones y deberes, o para designar a terceros bajo figuras legales de cuidado. La sola voluntad de ser padre/madre o de ser hijo no es la causa del lazo jurídico de filiación, aunque su incidencia varía en cada una de las fuentes de la Filiación.
