In this work we address the possible non-contractual liability of the public Administration as a consequence of actions taken during the state of emergency. Our attention is directed mainly to the burden of proof to which, under normal conditions, the claimant must submit and which in the current context could be lightened precisely by the exceptional conditions in which the decisions of the administration are acting. In this sense, it seems interesting to study the patrimonial responsibility norms of the public administration, considering the flexibility they offer to determine if a reversal of the burden of proof is admissible, although only theoretically. La declaración del estado de alarma no solo produce ciertas limitaciones a los derechos fundamentales, sino que también ocasiona incertidumbre frente a las posibles consecuencias jurídico-patrimoniales en las que los ciudadanos pueden verse involucrados. En este trabajo abordamos la posible responsabilidad extracontractual de la Administración pública como consecuencia de acciones adoptadas en el seno del estado de alarma. Nuestra atención se dirige principalmente a la carga de la prueba de la culpa a la que, en condiciones normales, debe someterse el reclamante y que en el actual contexto podría verse aligerada precisamente por las condiciones de excepcionalidad en la que actúan las decisiones de la Administración. En este sentido parece interesante tratar las normas en materia de responsabilidad patrimonial de la Administración pública considerando la flexibilidad que estas ofrecen para determinar si es admisible, aunque solo teóricamente, la inversión de la carga de la prueba de la culpa.
