This academic article aims to address a complex point of today, which is the streaming service provided by Netflix and its relationship with Administrative Law. The study seeks to analyze how the Public Administration should influence the regulation of such new technologies. Eventual regulation will have direct effects not only on the Public Administration, but also on the private initiative, since the telecommunication services do not have any regime of state exclusivity. Thus, first will be presented notions of public service in the Constitution of 1988 and by the administrativist scholars, passing through historical debates realized by the doctrine. Also at this point, the state influence and its political choices will be debated regarding the services that will be considered public. Next, the article will deal specifically with the public services of sound broadcasting and of sounds and images, in order to clarify their legal contours. That said, the case of Netflix will be analyzed considering the previously established concepts, so that it can be demonstrated that the service provided by it is not confused with traditional broadcasting services and Conditional Access Service. Finally, the study is concluded in order to identify the degree of its impact on Public Administration. O presente artigo acadêmico tem o intuito de versar sobre um complexo ponto da atualidade, qual seja o serviço de streaming fornecido pela Netflix e sua relação com o Direito Administrativo. O estudo busca analisar como deve a Administração Pública influir na regulação de tais novas tecnologias. Eventual regulação causará efeitos diretos não só sobre a Administração Pública, mas também na iniciativa privada, na medida em que os serviços de telecomunicação não possuem qualquer regime de exclusividade estatal. Assim, primeiramente serão apresentadas noções de serviço público na Constituição de 1988 e pelos doutrinadores administrativistas, passando por debates históricos realizados pela doutrina. Ainda nesse ponto, será debatida a influência estatal e suas escolhas políticas quanto aos serviços que serão considerados públicos. Em seguida, tratar-se-á especificamente dos serviços públicos de radiodifusão sonora e de sons e imagens, de modo a esclarecer seus contornos jurídicos. Posto isso, o caso da Netflix será analisado considerando os conceitos sedimentados anteriormente, para que se possa demonstrar que o serviço por ela prestado não se confunde com os serviços de radiodifusão tradicionais e de Serviço de Acesso Condicionado. Enfim, conclui-se o estudo de maneira a identificar o grau de sua incidência sobre a Administração Pública.
