Specifically, the Internet constitutes a new dimension of the "being" and "being of the person." Cyberspace is a dimension in which human beings have found a networked digital ecosystem in which they can expand the scope for the exercise of human freedoms. However, it also represents a space in which these freedoms can be limited, or even suppressed. The use of this resource has also modified the social contract in its classic terms, as political categories such as the nation-state have weakened, giving way to a process of reconfiguration marked by the globalization of communications and commerce. Based on this, this reflection is presented, aimed at analyzing a social phenomenon that has resulted in the need to consider the reconfiguration of the political and legal paradigms that underpin modern democracies. En este producto de investigación se abordan algunos de los retos para el ámbito jurídico en torno al uso de recursos tecnológicos. Concretamente, internet constituye una nueva dimensión del “ser” y “estar de la persona”. El ciberespacio es una dimensión en la cual el ser humano ha encontrado un ecosistema digital en red en el cual puede ampliarse la esfera para el ejercicio de las libertades humanas. Sin embargo, ello también representa la existencia de un espacio en el cual pueden llegar a limitarse dichas libertades, o incluso a suprimirse. El uso de este recurso también ha modificado el contrato social en sus términos clásicos, pues categorías políticas como Estado-nación se han debilitado para dar paso a un proceso de reconfiguración marcado por la globalización de las comunicaciones y del comercio. Con base ello, se presenta esta reflexión, encaminada al análisis de un fenómeno social que ha traído como consecuencia la necesidad de pensar en la reconfiguración de los paradigmas políticos y jurídicos que sustentan las democracias modernas.
