This process entailed both a re-signification of democracy and a reconfiguration of law. Since 1983, it is no coincidence that all legislation — particularly the new Civil and Commercial Code (CCCN) — has been enacted under the ideological influence of the constitutional paradigm, with guiding principles and rules designed to guarantee human rights and protect human dignity. The paper invites a reflection on the importance of remembering where we come from, as a means to better understand what we have achieved. Este artículo pretende repasar el contexto político- institucional de los últimos cuarenta años en Argentina, marcados por la democracia constitucional recuperada. La misma, trajo aparejada una re-significación de la democracia y una re-configuración del derecho. Desde 1983 y hasta nuestros días, no fue casual que toda la legislación, en especial el nuevo CCCN, fuera sancionada con una impronta ideológica propia del paradigma constitucional, con principios rectores y reglas establecidas para garantizar los derechos humanos y la protección de la persona en su dignidad.
