Furthermore, it establishes that the provinces have the original domain of the natural resources found in their territory (art. 124 CN). The objective of this work is to analyze the discussions and controversies about environmental federalism that were generated during the processes of sanction and implementation of Law 26,639 of Minimum standards for the Preservation of Glaciers and the Periglacial Environment. This norm establishes the criteria for the protection of these ecosystems to preserve them as strategic reserves of water resources and prohibits mining activity in these areas. The discussions for the Glaciers Law have been crossed by the federalization/centralization dichotomy and the tensions due to the application of articles 41 and 124 CN. During this process, disputes (re)emerged between pro,mining actors and environmentalists/anti,extractivists regarding provincial autonomy over the domain, use and management of natural resources. La Constitución Nacional Argentina asigna a la Nación la función de dictar las normas que contengan los presupuestos mínimos de protección, y a las Provincias la tarea de sancionar las normas necesarias para complementarlos (art. 41 CN), las cuales pueden otorgar una protección ambiental mayor pero nunca inferior a los presupuestos mínimos federales. Asimismo, establece que las provincias poseen el dominio originario de los recursos naturales que se encuentran en su territorio (art. 124 CN). Este trabajo tiene por objetivo analizar las discusiones y controversias sobre el federalismo ambiental que se generaron durante los procesos de sanción e implementación de la Ley 26.639 de Presupuestos Mínimos para la Preservación de los Glaciares y del Ambiente Periglacial. Esta norma establece los criterios para la protección de esos ecosistemas con el fin de preservarlos como reservas estratégicas de recursos hídricos y prohíbe la actividad minera en esas áreas. Las discusiones por la Ley de Glaciares han estado atravesadas por la dicotomía federalización/centralización y las tensiones por la aplicación de los artículos 41 y 124 CN. Durante este proceso (re)surgieron disputas entre actores promineros y ambientalistas/anti,extractivistas con respecto a la autonomía provincial sobre el dominio, uso y gestión de los recursos naturales.
