La utilización de las técnicas de reproducción humana asistida ha sido y sigue siendo un tema de debate entre la ciencia y el derecho. El derecho sucesorio del hijo póstumo proveniente de técnicas de reproducción humana asistida provoca una alteración a las estructuras familiares tradicionales, las cuales deben ser reguladas en forma clara y precisa al tiempo de establecer la filiación y el derecho que de ella deriva en relación a la transmisión mortis causa. Se ha realizado un análisis de los distintos antecedentes jurisprudenciales en la utilización de técnicas de reproducción humana asistida y esto ha generado una diversidad de situaciones que merecen un adecuado tratamiento ante la insuficiente normativa con el objetivo de dar seguridad jurídica y adecuada protección a la vida del ser humano desde su origen. The use of assisted human reproduction techniques has been and continues to be a subject of debate between science and law. The inheritance right of the posthumous child resulting from assisted human reproduction techniques causes an alteration to the traditional family structures which must be regulated in a clear and precise manner at the time of establishing filiation and the right derived from it in relation to the transmission mortis causa.
