description The present work intends to analyze the identity experience of transsexuality, through the studies of Butler, in order to discuss the difficulties faced due to the lack of public policies directed to this part of the population. Moreover, because of an incompatibility between gender and morphological sex, the rights of the transsexuals are left to the margin, having to face daily battles to have their rights assured, including, in relation to the dignity of the human person, which is inherent to any being regardless of gender or sexuality. In view of the presented scenario, it is necessary to have a public policy based on the implementation of a gender identity law in Brazil to enforce the rights of transsexuals, thus making the judicial search unnecessary in order to achieve rectification in the name change registry and registered in the personal documentation, whenever they do not match their gender identity.
