The right to identity was founded as a consequence of the participation of Abuelas in the United Nations Convention on the Rights of the Child in 1989. The international treaty became then an unavoidable reference for all child restitution processes. The objective of the work is to examine the political and symbolic importance of the participation of Abuelas in the Convention on the Rights of the Child and to study how it impacted the judicial processes and sentences by appropriation El artículo analiza las tensiones existentes entre las demandas de Abuelas de Plaza de Mayo y la orientación sociopolítica del Estado a fines de la década del ‘80 y principios de los ’90. Como consecuencia de la participación de Abuelas en la Convención sobre los Derechos del Niño de las Naciones Unidas en 1989, se fundó el derecho a la identidad; asimismo, el tratado internacional se convirtió en una referencia ineludible para los procesos de restitución de niños y niñas. El objetivo del trabajo es examinar la importancia política y simbólica de la participación de las Abuelas en la Convención sobre los Derechos del Niño y estudiar el modo en que ésta impactó en los procesos y sentencias judiciales por apropiación O artigo analisa as tensões entre as demandas das Avós da Plaza de Mayo e a orientação sócio-política do Estado no final dos anos 1980 e início dos 1990. Como consequência da participação das Avós na Convenção sobre os Direitos da Criança das Nações Unidas em 1989, o direito à identidade foi fundado; da mesma forma, o tratado internacional tornou-se uma referência incontornável para os processos de restituição de meninos e meninas. O objetivo do trabalho é examinar a importância política e simbólica da participação das Avós na Convenção sobre os Direitos da Criança e estudar a forma como ela impactou os processos judiciais e as sentenças de apropriação.
