For this, the underlying conceptions of disability that operate when intervening professionally are put in tension, differentiating the individual medical model from the social model of disability. Although there are advanced laws on the matter, such as the Convention on the Rights of Persons with Disabilities, these are not always reflected in practices, since the hegemony of the medical model still passes through judicial operators, families, rehabilitation professionals and even social workers. In order to question our professional interventions, it is not only necessary to rethink from what vision of disability we do it, but also to recognize the laws that we can use as tools so that people with disabilities can exercise their legal capacity, therefore, a brief presentation of the themselves. Finally, it is proposed to reflect on the possibilities of social work intervention in the dispute with the medicalizing and disabling logics that daily violate the right to decide of people with disabilities. El presente trabajo es una invitación a reflexionar, ejemplificando a partir de una situación particular, sobre la intervención del trabajo social en torno al derecho a decidir de las personas con discapacidad; específicamente sobre el instituto de la “curatela” o la “designación judicial de apoyos”. Para ello se pone en tensión las concepciones subyacentes sobre discapacidad que operan a la hora de intervenir profesionalmente, diferenciando el modelo médico individual del modelo social de la discapacidad. Si bien existen leyes de avanzada en la materia, como puede ser la Convención sobre los derechos de las personas con discapacidad, no siempre las mismas se ven reflejadas en las prácticas, ya que la hegemonía del modelo médico aún atraviesa a operadores judiciales, familias, profesionales de la rehabilitación e incluso a les trabajadores sociales. Para poder interpelar nuestras intervenciones profesionales no sólo es necesario repensar desde qué visión de la discapacidad lo hacemos sino reconocer las leyes que podemos utilizar como herramientas para que la personas con discapacidad pueda ejercer su capacidad jurídica, por tanto, ser realiza una breve presentación de las mismas. Finalmente, se propone reflexionar sobre las posibilidades de intervención del trabajo social en la disputa con las lógicas medicalizantes e inhabilitantes que vulneran cotidianamente el derecho a decidir de las personas con discapacidad.
