The author argues that it is a difficult operation due to the deep roots of political theology in the constitution of the modern political lexicon. Next, it probably reconstructs the controversy between Schmitt and Benjamin on political theology and then examines the problematic of constituent power in Schmitt's work and in the contemporary philosophical-political debate. After penetrating into schmittian institutionalism and its commitments to the Nazi regime, arguing that Schmitt will not come out of decisionist monism losing all innovative analytical potential in the field of institutionalism. Finally, the author delves into Romano's institutionalist thought, highlighting the relationship between law and its "outside" in three dimensions: the non-legal, the pre-legal and the anti-legal. After studying these three dimensions, the author concludes that Romano's legal ontology is protected from any theological-political excess El artículo analiza el problema del institucionalismo en la obra de Carl Schmitt y Santi Romano desde el horizonte de la crítica de la teología política. El autor sostiene que se trata de una operación difícil por las profundas raíces de la teología política en la constitución del léxico político moderno. Seguidamente, reconstruye brevemente la controversia entre Schmitt y Benjamin sobre la teología política y examina la problemática del poder constituyente en la obra de Schmitt y en el debate filosófico-político contemporáneo. Después penetra en el institucionalismo schmittiano y sus compromisos con el régimen nazi, argumentando que Schmitt no logró salir del monismo del decisionismo, perdiendo todo potencial analítico innovador en el campo del institucionalismo. Finalmente, el autor se adentra en el pensamiento institucionalista de Romano poniendo de relieve la relación del derecho con su “afuera” en tres dimensiones: lo no-jurídico, lo pre-jurídico y lo antijurídico. Luego de estudiar estas tres dimensiones, el autor concluye que la ontología jurídica de Romano queda a reparo de toda excedencia teológico-política.
