The various conflicts in the Middle East and North Africa, have led to the forced displacement of millions of people. Many of them seeking asylum, aspire to join the European Union by land or sea. Against this, the European Council decided to approve on March 18 a joint statement with the President of Turkey, Recep Tayyip Erdogan, to manage with the massive inflow of migrants who arrive daily from Turkey to Greece, the easiest access. However, the EU-Turkey Agreement, which besides having a dubious legal provenance, is said to be established for the purpose of thwarting the activity model of traffickers and give migrants an alternative to risk their lives, has a hidden side ostensibly contradictory with the International Refugee law. This article, initially seeks to clarify the legal nature of the agreement in question and then attempts to research the inconsistencies among the agreed between the parties and the obligations undertaken in the field at the international level. Por estos días, Europa y el mundo son testigos de una crisis humanitaria tan drástica como aquella suscitada a causa de la Segunda Guerra Mundial. Los distintos focos de conflicto en Oriente Medio y el Norte de África, han provocado el desplazamiento forzado de millones de personas. Muchas de ellas, en busca de asilo, aspiran a ingresar a la Unión Europea por tierra o por mar. Frente a esto, el Consejo Europeo decidió homologar el 18 de marzo de 2016 una declaración conjunta con el presidente de Turquía, Recep Tayyip Erdogan, para hacer frente al flujo masivo de migrantes que arriban diariamente desde Turquía a Grecia, la vía más accesible. Sin embargo, el Acuerdo Unión Europea-Turquía, que además de contar con una dudosa procedencia jurídica dice establecerse a los efectos de frustrar el modelo de actividad de los traficantes y ofrecer a los migrantes una alternativa a arriesgar sus vidas, posee un lado oculto que contradice ostensiblemente el Derecho Internacional de los Refugiados. Éste artículo, busca inicialmente esclarecer la naturaleza jurídica del acuerdo en cuestión y posteriormente intenta ahondar en las inconsistencias entre lo convenido entre las partes y las obligaciones asumidas en la materia en el plano internacional.
