El presente artículo pretende contextualizar la manifestación del poder constituyente en el año 2020 en dos sociedades particulares: Chile y Perú. Dos fenómenos socio-jurídicos bien diferenciados desarrollados en el contexto de una pandemia, pero que reflejan síntomas del mismo malestar de las democracias nuestroamericanas en el ethos capitalista neoliberal: la exclusión y pauperización de cuantías cada vez mayores de la humanidad.
