Access to urban land is considered as an essential element of any public policy. However, if it is an importance and needed right, it doesn’t have the same history of legal recognition as the right to housing, education and/or health. Given this, the following questions arose: How has the evolution been in terms of public land management policy in Argentina with a focus on the province of Buenos Aires? If it is a basic right, does it enjoy the necessary legal recognition? so, is it enough? Through the analysis of the historical evolution in terms of public policy in Argentina, with a focus on the province of Buenos Aires, it is intended to make a contribution to the debate on access to land as a basic right, while it is intended to rescue its potential. , as one –not the only one- of the necessary elements to exercise the Right to the City. Resumen La investigación propuesta es parte integrante de los emergentes de un trabajo doctoral sobre la relación existente entre la aplicación de políticas públicas de gestión de suelo urbano por parte de los Ejecutivos locales y el mejoramiento en las condiciones de acceso a la vivienda, al hábitat y al ejercicio del Derecho a la Ciudad. En dicho marco, se parte de considerar al acceso al suelo urbano como un elemento indispensable de toda política pública. Sin embargo, a pesar de su importancia y necesidad, a la fecha, no tiene la misma historia de lucha y reconocimiento jurídico que el derecho a la vivienda, a la educación y/o salud. Ante ello, surgieron los siguientes interrogantes ¿Cómo ha sido la evolución en materia de política pública de gestión de suelo en Argentina con foco en la provincia de Buenos Aires?, Si es un derecho básico ¿Goza del reconocimiento legal necesario?, y si ello es así, ¿Resulta suficiente? Mediante el análisis de la evolución histórica en materia de política pública, de Argentina, con foco en la provincia de Buenos Aires, se pretende realizar un aporte al debate sobre el acceso al suelo como derecho básico, a la vez que se pretende rescatar su potencialidad, como uno –no el único- de los elementos necesarios al ejercicio del Derecho a la Ciudad.
