The current legal system accepts the social model of disability, leaving aside the medical-rehabilitative model that contemplated the repealed code, also keeping coherence with Law 26657 on Mental Health (2010), which incorporated the postulates of the CRPD into our internal law , and I constitute the starting point from which this path was exalted towards another perspective, since it recognizes the right to access comprehensive mental health care according to the needs of the case on a level of equality and non-discrimination. In this context, we consider it necessary to address the scope of both the CRPD, the national and local regulations,  contemplating the material and formal validity. As well as, weigh the adequacy to the guidelines of the substantial regulations in judicial practice, based on the principles enshrined in the CCC, such as the interdisciplinary approach, the possibility of participation of the subject in the process under the gaze of the person with differences as a subject of law, emphasizing their ability and the best way to integrate socially under the new support system. El Código Civil y Comercial (2015) introduce cambios respecto a los derechos de las personas con discapacidad, armonizando así la legislación interna con los principios de la Convención sobre Derechos de las Personas con Discapacidad (CDPD). El actual ordenamiento jurídico recepta el modelo social de la discapacidad dejando de lado el modelo médico-rehabilitador que contemplaba el código derogado, guardando coherencia también con la ley 26657 de Salud Mental (2010), que incorporó en nuestro derecho interno los postulados de la CDPD, y constituyó el puntapié inicial a partir del cual se enalteció este camino hacia otra mirada, pues reconoce el derecho a acceder a la atención integral de su salud mental de acuerdo a las necesidades del caso en un plano de igualdad y no discriminación. En este contexto, estimamos necesario tratar el alcance tanto de la CDPD, de las normas nacionales y locales, contemplando la validez material y formal. Como así también, ponderar la adecuación a las pautas de la normativa fondal en la praxis judicial, sobre la base de los principios consagrados en el CCC, tales como el abordaje interdisciplinario, la posibilidad de participación del sujeto en el proceso bajo la mirada de la persona con diferencias como sujeto de derecho, recalcando su capacidad y la mejor manera de integrarse socialmente bajo el novel sistema de apoyos.
