We use the theoretical approach of Harold Koh in his The National Security Constitution in order to describe a cycle of National Defense Constitution in Argentina. We use the discursive analysis as a research methodology of four important cases resolved by the Court. From this analysis, we systematize the fundamental rules of the Court on the topic. The importance of this approach is, in the one hand, because the lack of systematical studies from constitutional law on military powers in Argentina and, in the other, because with these four cases the Court has made the judicial rules on military powers that has not changed in other cases. En el presente trabajo analizamos la jurisprudencia de la Corte Suprema de Justicia de la Nación Argentina en relación con los poderes militares establecidos en la Constitución en un periodo de la historia marcado por la participación formal del país en una guerra internacional y conflictos armados internos, según el criterio de la propia Corte. El objetivo es describir la forma en que el máximo tribunal nacional ha interpretado las facultades de defensa nacional y ha controlado, avalado o rechazado su utilización por el Poder Ejecutivo y el Poder Legislativo. Nos valdremos del marco teórico expuesto por Harold Koh en su obra The National Security Constitution para elaborar una parte del “ciclo” de la Constitución de la Defensa Nacional en Argentina. Empleamos el análisis discursivo como metodología de investigación de cuatro causas importantes de la historia de la Corte Suprema de Justicia. A partir de este análisis, sistematizamos las reglas fundamentales del tribunal sobre la problemática. La importancia de este abordaje radica, por un lado, en la falta de estudios sistemáticos desde el derecho constitucional de los poderes militares y, por el otro, en que las causas analizadas sentaron una jurisprudencia que no ha sido modificada por el máximo tribunal.
