DE LA TEORÍA MARXISTA DEL DERECHO DE PASHUKANIS A EL CAPITAL DE MARX Cristeche, Mauro Pashukanis Marxism State Law Economy Pashukanis marxismo Estado Derecho Economía This paper is involved in the theoretical debates about law in the early years of the Russian Revolution and presents a critical analysis of General Theory of Law and Marxism, the famous work of Evgeny Pashukanis, one of the greatest legal exponents of that process historical. From the theoretical analysis, systematically developed within the framework of a seminar on the subject, this work tries to rescue the main contributions of the work of Pashukanis, both to the Marxist and juridical debate, and to make a critique of its conception of the relationship between law and economy, seeking to recover Marx's Capital by linking the movement of capital with legal forms. It also contains a brief overview of the significance of the Russian Revolution as a historical process and the figure of Pashukanis in the framework of major debates on the role of law in a proletarian State, and the link between its developments and those of Marx and Engels. The purpose will be to account for the valuable effort of the Russian jurist to build a theory of law on the basis of historical materialism, as well as the need for a critical reading of his work. Este trabajo se involucra en los debates teóricos en torno al derecho en los primeros años de la Revolución Rusa, y presenta un análisis crítico de Teoría general del derecho y marxismo, la famosa obra de Evgeny Pashukanis, uno de los máximos exponentes jurídicos de ese proceso histórico. A partir del análisis teórico, desarrollado con sistematicidad en el marco de un seminario sobre la temática, el trabajo intenta rescatar los aportes y principales contribuciones de la obra de Pashukanis, especialmente en lo relativo al paralelismo entre sujeto y mercancía, y realizar una crítica a su concepción sobre la relación entre derecho y economía, buscando recuperar el vínculo del movimiento del capital con las formas jurídicas desarrollado en El capital de Marx. Contiene también una breve reseña sobre el significado de la Revolución Rusa como proceso histórico y la figura de Pashukanis en el marco de grandes debates sobre la función del derecho en un Estado proletario, y la vinculación entre sus desarrollos y los de Marx y Engels. Se espera dar cuenta del valioso esfuerzo del jurista ruso para construir una teoría del derecho sobre la base del materialismo histórico, al mismo tiempo que la necesidad de una lectura crítica de su obra.
