Desde un marco conceptual que incluye avances en políticas lingüísticas y en ciencia política, se argumenta que estas diferencias respondieron en cada caso a las transformaciones políticas e institucionales resultantes de 1) el contexto sociopolítico de cada órgano; 2) su composición y; 3) los mecanismos de participación. Estos tres elementos conjugados abrieron la posibilidad de una legislación multilingüe en el primer proceso y la cerraron en el segundo. Luego del fracaso de ambos órganos y el rechazo de sus propuestas, la tradición estatal chilena y su régimen monolingüe hegemónico en castellano continúan en pie. I trace the political origins of the different language legislations in the two bodies charged with producing a new constitution during the recent critical juncture of the constitutional moment in Chile. Resorting to a conceptual framework that takes elements from language policies and political science, I argue that these differences were the result, in each case, of the political and institutional transformations and arrangements manifested in 1) the sociopolitical context of each body; 2) their composition; and 3) the mechanisms of participation. These three elements in conjunction facilitated, in the first case, and prevented, in the second case, the possibility of multilingual legislation. After the failure of both processes, the Chilean state tradition and its hegemonic monolingual regime in Spanish continue to be in place.
