In 1992, the Supreme Court of Justice of the Nation defined that international law and national law make up the same legal system, establishing a monist position. In 1994, the reform of the national Constitution confirmed this position and granted constitutional hierarchy to the various norms regarding human rights. Consequently, a minimum floor of rights for all people was established. Subnational States found themselves with a broad set of new obligations to respect, added to the new services they received through the decentralization process of the State Reform. All this without new resources or sources of financing to meet the new expenses. Therefore, a «strangulation» occurs at the subnational level, as a result of pressure to satisfy these new demands of international treaties. This process constituted a transformation of the centralized plural federalism, which Argentina had adopted in the 19th century.  Los derechos humanos constituyen un repertorio de libertades y derechos inherentes a cada uno de los seres humanos, sobre la base de su igualdad y dignidad personal y social. En 1992, la Corte Suprema de Justicia de la Nación definió que el derecho internacional y el derecho nacional integran un mismo ordenamiento jurídico, instaurando una postura monista. En 1994, la reforma de la Constitución Nacional confirmó esa posición y otorgó jerarquía constitucional a las diversas normas en materia de derechos humanos. Se configuró, en consecuencia, un piso mínimo de derechos para todas las personas. Los Estados subnacionales se encontraron con un conjunto amplio de nuevas obligaciones a las que respetar, sumado a los nuevos servicios que recibió por el proceso de descentralización de la Reforma del Estado. Todo ello sin nuevos recursos o fuentes de financiamiento para cumplir con los nuevos gastos. Se produce, entonces, un «estrangulamiento» a nivel subnacional, producto de la presión para satisfacer estas nuevas exigencias de los tratados internacionales. Este proceso constituyó una transformación del federalismo plural centralizado, que Argentina había adoptado en el siglo XIX.
