By a side, the corresponding to the subject population, characterized by a high vulnerability, expressing basic needs deepened by judicial intervention. On the other hand, the institutional mandate, that is the request for intervention from the institution that contracts it. This request seeks answers that have legal consequences, that is, they are mainly linked to the judiciary and the application of the state punitive apparatus. In this dynamic recurrent, in the professional practice, the uncritical task in relation to the criminal question. The analysis of the social question and its impact within the scope are excluded in the intervention, making criminological readings focused exclusively on the "delinquent individual". Thus, in the present work we will advance in the reading of that tension, problematizing the role of social work in the criminal sphere, its reading of the social question and its relation to the criminal question. El trabajo social en instituciones relacionadas con la ley penal se encuentra entrampado en una tensión permanente entre dos demandas de intervención. Por un lado, la correspondiente a la población sujeto, caracterizada por una alta vulnerabilidad, expresando necesidades básicas profundizadas por la intervención judicial.Por otro, se enfrenta al encargo institucional, es decir, al pedido de intervención de la institución que lo contrata. Esta solicitud busca respuestas que tienen consecuencias legales, debido a que se encuentran vinculadas principalmente con el poder judicial y la aplicación del aparato punitivo estatal. En esa dinámica se presenta de manera recurrente en el ejercicio profesional, una mirada acrítica de la cuestión penal. El análisis de las manifestaciones de la cuestión social y su impacto dentro del ámbito suelen quedar excluidos en la intervención, realizando lecturas criminológicas centradas exclusivamente en el “individuo delincuente”. En el presente trabajo avanzaremos en la lectura de aquella tensión, problematizando el rol del trabajo social en el ámbito penal, su lectura de la cuestión social y la relación con la cuestión penal.
