Instead, reality is precisely the opposite. The loopholes, redundancies, and contradictions are unavoidable and unfortunately frequent, which threatens significant values of the system, such as justice and legal security. However, the rules of our legal system and the positivist conception underlying force to the operators involved –judges, lawyers and civil servant of any type- to give solutions to those normative problems. The “preventive action of damage” is not anexception, and the recent passing of the Civil and Commerce Code obligates the interpreters to deal with these issues on the task of legal construction. Because of that, this paper focuses on making visible the legal matters that preventive action brings within the procedural microsystem in the Province of Córdoba, and suggests certain kind of solutions to return to the normative system the values that we assign it, such as completeness, independence and consistency. La producción normativa del legislador está lejos de ser una tarea armónica, coherente y completa. Más bien, el fenómeno que puede observarse en la realidad es exactamente lo opuesto. Las lagunas -de todo tipo- redundancias y antonomias son inevitables e indeseablemente frecuentes, lo que atenta contra valores significativos del sistema como la justicia y seguridad jurídica. No obstante ello, las reglas de nuestro sistema jurídico y las concepciones positivistas subyacentes obligan a los operadores intervinientes -jueces, abogados y funcionarios de todo tipo- a dar soluciones a tales problemas normativos. La acción preventiva de daños no es una excepción, y la consagración normativa en la novel sanción del Código Civil y Comercial obligan a los intérpretes a lidiar con estos tópicos en la tarea de construcción jurídica. En razón de ello, este trabajo está enfocado en hacer visibles los problemas jurídicos que trae aparejada esta acción en el microsistema procesal de la Provincia de Córdoba, y a sugerir posibles soluciones a los fines de devolverle al sistema normativo aquellos valores que se le atribuyen, tales como completitud, independencia y coherencia.
