Its purpose is to characterize the genre Petition and provide a basis for the subsequent stages of the project: the inter- and intralinguistic contrast with other genres and the analysis of the degree of terminological variation in certain text types, as well as the correlation between said variation and the genre the text realizes. Legal genres («those generated in the creation, enforcement, spreading of, and research about Law» [Borja Albi, 2007, p. 141]) constitute, just like any other genres, «relatively stable types» (Bajtín, 1998, p. 245) that have been characterized from the different perspectives that impact upon their production and reception: the context in which they are circulated, the relationship with other genres from different repertoires, its structure aspects, its pragmatic sides, etc. The significance of a generic analysis is undeniable. As Bajtín (1998) puts it, «Speech genres organize our speech […] If speech genres did not exist and we had not mastered them […] speech communication would be almost impossible» (p. 265). Furthermore, we acknowledge their pedagogical importance, since we agree with Alexopoulou (2011), who explains that familiarizing students with genres will enrich their education because it will allow them not only to understand texts but to produce them respecting their conventions and «knowing what to say to whom and how to say it properly in a particular situation» (p. 105). Given the complexity intrinsic to genre analysis, in this work we will start from the classification of legal texts proposed by Borja Albi (2000) and then apply the analysis model proposed by Ciapuscio and Kuguel (2002), which studies four «levels» (functions, situation, semantic content and form), in order to provide an initial description of the genre in focus.

Este trabajo forma parte de la primera etapa del proyecto de investigación titulado Variación terminológica: estudio plurilingüe contrastivo en el ámbito jurídico y técnicocientífico y posibilidades de representación y gestión informatizada, del grupo GITEL (Facultad de Lenguas). Su propósito es caracterizar el género de la demanda en inglés y sentar las bases paras etapas posteriores del proyecto: el contraste inter- e intralingüístico con otros géneros y el análisis del grado de variación terminológica de ciertos tipos de texto, así como la relación entre dicha variación y el género en que el texto se inserta. Los géneros jurídicos («los generados en la creación, aplicación, difusión e investigación del Derecho» [Borja Albi, 2007, p. 141]) constituyen, como cualquier género textual, «tipos relativamente estables» (Bajtín, 1998, p. 245) que han sido caracterizados desde las distintas perspectivas que impactan en su producción y recepción: el contexto donde circulan, la relación con otros géneros de distintos repertorios, sus aspectos estructurales, su faceta pragmática, etc. La relevancia de un análisis de tipo genérico es innegable. Como dice Bajtín (1998), «los géneros discursivos organizan nuestro discurso […]. Si no existieran los géneros discursivos y si no los domináramos […], la comunicación discursiva habría sido casi imposible» (p. 265). Además, defendemos su importancia pedagógica, ya que acordamos con Alexopoulou (2011), que explica que hacer conocer los géneros a los estudiantes enriquecerá su formación porque les permitirá no solo comprender textos, sino también producirlos respetando sus convenciones para «saber qué decir a quién y cómo decirlo de forma adecuada en una situación determinada» (p. 105). Dada la complejidad inherente al análisis de los géneros, en este trabajo partiremos de la clasificación de textos jurídicos propuesta por Borja Albi (2000), para luego tomar como modelo de análisis el propuesto por Ciapuscio y Kuguel (2002), que estudia cuatro «niveles» (funciones, situación, contenido semántico y forma), a fin de lograr un primer acercamiento al género que nos convoca.
