For this, we begin with a brief review of sexual rights under a human rights approach. In Mexico, this process has taken place gradually in different states of the country, through legislative changes and through sentences, criteria and standards of the federal justice system in compliance with the protection and guarantee of the normative principle of non-discrimination (which the Political Constitution recognizes as ius cogens). Likewise, there is evidence of actions in favor of recognition from certain sectors of civil society, as well as some actions for and against by the federal government, which at certain times has hindered and at other times has promoted the protection of rights for the LGBT+ population, tensions that constantly put at risk the achievements that have been made. El presente artículo hace una revisión del proceso político-legislativo que ha seguido el matrimonio igualitario en México. Para ello, partimos de una somera revisión de los derechos sexuales bajo la lógica de los derechos humanos. En México, este proceso se ha dado de manera paulatina en diferentes entidades federativas del país, a través de cambios legislativos y a través de sentencias, criterios y estándares del sistema de justicia federal en cumplimiento de la protección y garantía del principio normativo de no discriminación (que la Constitución Política ordena como ius cogens). Asimismo, se evidencian las acciones a favor del reconocimiento desde ciertos sectores de la sociedad civil, así como algunas acciones a favor y en contra por parte del gobierno federal, el cual en ciertos momentos ha obstaculizado y en otros ha impulsado la protección de los derechos para la población LGBT+, tensiones que constantemente ponen en riesgo los logros conquistados.
