The method of procedural comparative law research about the sources of law, from constitutional and conventional to national and local legislation and procedural rules, as well as analyzing jurist’s doctrines from the legal dogmatic scope. Then, presents the application of the AI in the Judiciary differencing uses as: i) strong and weak applications, ii) human rights scope centered on human beings and their algorithmic dignity, digital identity, and the search of common good. Besides, the analysis of the algorithmic justice from the predictive algorithm to the auxiliar algorithm viewed through the lenses of the judicial warrants, procedural principles, digital principles and rights, and ethical principles for algorithms centered on human beings. The proposal is to set the topic for the application of AI on the civil digital process. Abordamos la aplicación progresiva de la Inteligencia Artificial (en adelante la IA) al proceso judicial digital, en el marco de las garantías debido proceso digital y de la defensa en juicio digital. Analizamos desde el derecho procesal comparado las fuentes legales constitucionales y convencionales, leyes nacionales y locales, así como su reglamentación, desarrollando un derecho procesal comparado interno -provincial- y, principalmente de Córdoba, y fuentes doctrinarias. Bajo esta perspectiva, las cuestiones centrales en el marco del bloque de constitucionalidad federal son las siguientes: La IA en la Justicia a través de las aplicaciones de fuerte y débil, con enfoque de derechos humanos centrado en la persona y su inalienable dignidad algorítmica e identidad digital y persecución del bien común. Además, desarrollamos la Justicia algorítmica desde el algoritmo predictivo hasta el algoritmo auxiliar, en el marco de las garantías judiciales, principios procesales, principios y derechos digitales y principios éticos para algoritmos centrados en el ser humano. Propiciamos determinar los ejes para la aplicación de la IA en relación al proceso digital civil.
