| Sumario: | At this moment, Chile is carrying out a process of constitutional transformation of great importance for the Southern Cone and the region, since it will reform its Constitution, which has not been modified in a general way since the disgraceful dictatorship of General Augusto Pinochet, one of the longest in South America. This historical moment means a unique opportunity and a democratic challenge for Chile, and the chileans, and invites us to consider the “equality legal right” and its couterpart, non-discrimination, from a gender perspective, sexual and gender diversity and its intersectionality’s in said constitutional and political context, to which we will focus in this Posdoctoral research, making visible the complexity of the process which continues, and the first text proposed by the Constitutional Convention rejected by the Plebiscite of September 4,2022, which represents important advances in relation to the constitutional inclusion of the rights related to the sex/gender system. |
