This historical moment means a unique opportunity and a democratic challenge for Chile, and the chileans, and invites us to consider the “equality legal right” and its couterpart, non-discrimination, from a gender perspective, sexual and gender diversity and its intersectionality’s in said constitutional and political context, to which we will focus in this Posdoctoral research, making visible the complexity of the process which continues, and the first text proposed by the Constitutional Convention rejected by the Plebiscite of September 4,2022, which represents important advances in relation to the constitutional inclusion of the rights related to the sex/gender system. En este momento, Chile lleva adelante un proceso de transformación constitucional de gran importancia para el Cono Sur y la región, ya que reformará su Constitución, que no ha sido modificada de manera general desde la dictadura del Gral. Augusto Pinochet, una de las más largas de América del Sur. Este momento histórico significa una oportunidad única y un desafío democrático para Chile, y los/as/es chilenos/as/es, e invita a considerar el “bien jurídico igualdad” y su contracara, la no discriminación, desde una mirada de género, diversidad sexual y de género y sus interseccionalidades en dicho contexto constitucional y político, a lo que nos abocamos en nuestra investigación Posdoctoral[1], visibilizando la complejidad del proceso, que continúa, y el primer texto propuesto por la Convención Constitucional rechazado por Plebiscito del 4 de septiembre del 2022, que representa avances importantes en relación a la inclusión constitucional de los derechos relativos al sistema sexo/género.
