This type of matter would be excluded from judicial review precisely because of the intrinsically political nature of the matters, with respect to which the Judicial Power would not be competent. This doctrine is controversial from various points of view. On the one hand, because its admission could mean a certain “resignation” to constitutional supremacy on certain issues. On the other hand, because in practice it has not been clear how many and what these issues are. At the same time, it is even controversial what is the basis of non-justiciable political issues. In this work, an attempt will be made to identify and systematize the possible foundations that doctrinally and jurisprudence have been offered to support the doctrine of political questions. La práctica constitucional ha acuñado una doctrina que supone admitir que hay cuestiones que se encuentran exentas del control judicial. Tal es la doctrina de la de las llamadas cuestiones políticas no justiciables. Este tipo de materias quedarían excluidas de la revisión judicial precisamente por el carácter intrínsecamente político de los asuntos, respecto de los cuales el Poder Judicial no sería competente. Esta doctrina es controvertida desde diversos puntos de vista. Por un lado, porque su admisión podría significar cierta “renuncia” a la supremacía constitucional en determinados temas. Por otra parte, porque en la práctica no ha sido claro cuantas y cuáles son esas cuestiones. A su vez, incluso, resulta controvertido cuál es el fundamento de las cuestiones políticas no justiciables. En este trabajo, se intentará identificar y sistematizar los posibles fundamentos que doctrinal y jurisprudencialmente se han ofrecido para sostener la doctrina de las cuestiones políticas no justiciables.
