description The definition, scope and regulation of genetic information at the international level are one of the most controversial issues in the current international environmental negotiations due to its direct consequences on the conditions of sustainable development. International negotiations are in a kind of political lock caused by divergent positions between developed and developing countries. This article is intended to describe genetic information as an object of study, the state of the international debate and some systemic effects of this discussion on some fundamentals of the contemporary international law, such as the principle of national sovereignty over natural resources. The current debate on access, control and benefit-sharing arising from the use of genetic information presents a situation in which the balance between sovereignty and privatization of natural resources is once again in tension
