In this aspect, Falcon makes an interesting historical study of the institution of the class action, concluding that, in the Anglo-Saxon, the class action is the oldest record of the representative action. In Argentina, the collective processes spread in the jurisprudence and legislation by alternative injunction, regulated in Article 43 of the Constitution, but there is no specific legislation that allows preach the existence of class action as a general category . It notes the need to treat collective disputes, considering homogeneous individual rights and collective goods. Moreover, it is necessary to study the collective process itself, and its central aspects such as standing, evidence and sentencing. Los procesos colectivos han llegado a ocupar un lugar importante en el mundo globalizado. El derecho ha reaccionado a partir del siglo XX, con respuestas para permitir el acceso a una justicia verdadera. En este aspecto, Falcón (2) realiza un interesante estudio histórico de la institución del proceso colectivo, para concluir que, en el ámbito anglosajón, la class action es el antecedente más lejano de la acción de representación. En Argentina, los procesos colectivos se expandieron en la jurisprudencia y en la legislación mediante la alternativa del juicio de amparo, reglado en el artículo 43 de la Carta Magna, pero sin legislación específica que permita predicar la existencia de la class action como categoría general. En el panorama a estudiar se advierte la necesidad de tipificar los conflictos colectivos, considerando los derechos individuales homogéneos y los bienes colectivos. Además, resulta necesario estudiar el proceso colectivo propiamente dicho, y sus aspectos centrales como la legitimación, la prueba y la sentencia.
