In studying systematically organized regulatory practices, however, a concept of law as institutionalized doctrine seems particularly useful. This does not restrict law to state law or “lawyers’ law”, but it treats the regulation produced and applied by agencies of the centralized state as the dominant form of contemporary law. Arguments around the concept of law serve as an essential starting point for trying to reinterpret legal theory and the field of law in sociological terms. ¿Cuál debería ser el tema central de la sociología del derecho? ¿Qué debería considerar como “derecho”? Las respuestas a estas preguntas no son autoevidentes, aunque resultan básicas en cualquier intento de desarrollar una teoría sociológica del derecho. En la literatura se encuentra una amplia variedad de enfoques. Al estudiar las prácticas regulatorias sistemáticamente organizadas, sin embargo, un concepto de derecho entendido como doctrina institucionalizada parece particularmente útil. Esto no restringe la noción al derecho del estado o al derecho tal como lo entienden los juristas, aunque trata la regulación producida y aplicada por las agencias del estado centralizado como las formas dominantes del derecho contemporáneo. Las discusiones en torno al concepto de derecho, sirven como un punto de partida esencial para tratar de reinterpretar la teoría jurídica y el campo del derecho en términos sociológicos.
