Bioprospecting poses great challenges to the legal system, both in terms of the space in which it is possible to exercise it and in relation to the conditions of its development, given the resurgence of the effects of territorial claims that could be caused by linking this activity with sovereignty over the natural resources of the respective claimant states. Transcurridos casi sesenta años desde la firma del Tratado Antártico (TA), el sistema antártico se ve ante tres nuevos grandes desafíos: el medio ambiente, que se proyecta sobre los otros dos: el turismo, y la bioprospección. La bioprospección a su vez plantea grandes desafíos al sistema jurídico vigente en la región, tanto en materia del espacio en el que sea posible su ejercicio cuanto en lo relativo a las condiciones de su desarrollo, habida cuenta del resurgimiento de los efectos de las reclamaciones territoriales que podría provocar por vincularse esta actividad con la soberanía sobre los recursos naturales de los respectivos Estados reclamantes.
