El abuso en los acuerdos concursales de sociedades que impiden su homologación judicial ha generado una respuesta pretoriana de ajuste: la “tercera vía”, con diversas modalidades. En este ensayo postulamos evitar que el intento judicial de ajustar la solución no implique una forma inadvertida de violar la ley, configurando un abuso de derecho, cuando no un fraude a la ley societaria.
