The object of this article is to show whether there really exists an agrarian property, distinct and with characters independent of common property; or whether on the contrary this agrarian property is nothing more than a species or form of civil property, and consequently that it does not need its own legal regimes, nor should it be freed from the general principles. El enunciado del título, dice que existe una propiedad distinta y diferenciada de la propiedad civil, comercial, minera, o de cualquier otra modalidad de este derecho. El problema no es nuevo; se ha agitado desde las primeras formas jurídicas y en las primeras organizaciones sociales y políticas, pero ha adquirido entre nosotros recientemente caracteres más típicos y salientes. El objeto de este artículo es demostrar si existe realmente una propiedad agraria, distinta y con caracteres independientes de la propiedad común; o si por el contrario esta propiedad agraria no es más que una especie o forma de la propiedad civil, y por consiguiente que ella no necesita regímenes legales propios, ni debe liberarse de los principios generales.
