<dc:description>La tesis aborda los discursos del Foro de Estudios sobre la Administración de Justicia (FORES), una usina de pensamiento local orientada a la elaboración de propuestas de reforma judicial. El objetivo es describir los modos en que el FORES problematiza la cuestión judicial desde su conformación en 1976 hasta el año 2019, a partir del análisis de un corpus documental construido en base a proyectos, artículos, gacetillas de prensa e informes elaborados por esta organización.
Esta investigación se inscribe en el marco de la perspectiva foucaultiana. En principio, recupera la idea de gobierno, buscando descentrar la mirada respecto al Estado e indagar la multiplicidad de autoridades que se proponen gobernar la cuestión judicial, poniendo el foco en el rol que adquieren las usinas de pensamiento o think tanks. En segundo lugar, se asienta en la idea de problematización con el objetivo de describir el modo en que el funcionamiento del sistema de justicia se configura progresivamente como un problema socialmente relevante sobre el cual es preciso intervenir. Finalmente, propone un enfoque geneo-arqueológico para el acercamiento al objeto de estudio. El abordaje genealógico permite indagar las condiciones que hicieron posible la emergencia de la reforma judicial como problema para el FORES, mientras que el abordaje arqueológico arroja luz sobre las formas que asume esa problematización a través del tejido discursivo. En función de la identificación de regularidades y dominancias, se organizó el análisis en función de cuatro series discursivas: la discursividad judicial conservadora, la discursividad judicial managerial, la discursividad judicial liberal selectiva y la discursividad judicial securitaria.</dc:description>
<dc:description>This thesis addresses the discourses of the Forum for Studies on the Administration of Justice (FORES), a local think tank that develops proposals for judicial reform. The objective is to describe the ways in which FORES problematizes the judicial question since its conformation in 1976 until 2019, through the analysis of a documentary corpus built on the basis of projects, articles, press releases and informs produced by this organization.
This research is inscribed in the foucaultian perspective. Firstly, it recovers the idea of government, seeking to decentralize the gaze with respect to the State and to investigate the multiplicity of authorities that intend to govern the judicial question, focusing on the role of think tanks. Secondly, it is based on the idea of problematization with the aim of describing the way in which the functioning of the justice system is progressively configured as a socially relevant problem on which it is necessary to intervene. Finally, it proposes a geneo-archaeological approach to the object of study. The genealogical approach makes it possible to investigate the conditions that made possible the emergence of judicial reform as a problem for FORES, while the archaeological approach sheds light on the forms assumed by this problematization through the discursive fabric. In order to identify regularities and dominances, the analysis was organized according to four discursive series: conservative judicial discursivity, managerial judicial discursivity, selective liberal judicial discursivity and securitarian judicial discursivity.</dc:description>
