Sumario:This work addresses the problem of abandoned children. The hypothesis that arises is that the issue of the abandoned child was a concern of the academic and political elite in the last decades of the nineteenth and early twentieth centuries that resulted in changes in legislation. At the beginning of the process of modernization of Argentina in the mid-nineteenth century, there was a large increase in population as a result of immigration promoted by the ruling elite. On the other hand, there was an increase in delinquency in all age groups. Several authors, among them Luis Agote, linked the growing child delinquency with the work they did on public roads. It should be noted that since the last decades of the nineteenth century scientific positivism has become a dominant doctrine. The question of the abandoned and delinquent child interested lawyers and doctors who tried to find a solution in criminology
