Sumario:The inability affects the legal capacity of people, placing them in a special situation of subjection to legal guard mechanisms, and it can only be declared in the previously established cases in the law, requiring of a previous process and sentences for such an effect. The Family Code regulates as legal guardian institutions the ?native imperium? and it guides her. However, it ignores others institutions that are of great importance like the autotutela, the guardianship, the native continued imperium and rehabilitated, the judicial defender, the de facto guard, administrative keeps and the family acogimiento. The recognition of legal guard institutions and care in the Cuban family classification would provide the appropriate roads for the attendance and unable people?s protection, discapaces and with restricted capacity, constituting a suitable mechanism for their participation in the juridical world.
