It is the duty of the Speaker of the Chamber of Deputies to conduct the initial review of the charges. This article examines whether the omission by the Speaker of the Chamber of Deputies to consider charges, or the decision to summarily dismiss them without deliberation by the full Chamber, may be subject to judicial review by the Supreme Federal Court (STF). To this end, the article investigates the relevant provisions of the 1988 Constitution and the impeachment legislation, with an analysis of the STF’s case law based on a survey of decisions issued between February 1990 and December 2022, using the search terms “impeachment and charges and ‘President of the Republic,’” resulting in 14 relevant cases. It finds that the STF has consolidated the understanding that the decision of the Speaker of the Chamber (and any omission to issue such a decision) is predominantly political in nature and not subject to judicial review — a position that weakens constitutional protections and the rule of law. The article argues that impeachment, although involving political bodies, constitutes a legal process of accountability for serious violations of the constitutional order, requiring observance of legality, due process of law, and the guarantee of access to justice. Thus, judicial review of omissions or arbitrary dismissals by the Speaker is essential to uphold the supremacy of the Constitution and to preserve democracy.

No sistema constitucional brasileiro, o processo de impeachment do Presidente da República pode ser instaurado em razão da prática de “crimes de responsabilidade”, assim denominadas as violações graves à ordem constitucional, previstas na Constituição e tipificadas em lei. Compete ao Presidente da Câmara dos Deputados realizar o primeiro exame da denúncia. O artigo examina se a omissão do Presidente da Câmara dos Deputados do Brasil em apreciar as denúncias, ou a decisão de arquivá-las liminarmente sem deliberação do plenário, pode ser objeto de controle judicial pelo Supremo Tribunal Federal (STF). Para tanto, investigam-se as disposições da Constituição de 1988 e da legislação do impeachment, com análise da jurisprudência do STF a partir de pesquisa das decisões proferidas entre fevereiro de 1990 e dezembro de 2022, utilizando os termos “impeachment e denúncia e ‘Presidente da República’’”, resultando em 14 casos que enfrentam a temática. Constatou-se que STF consolidou o entendimento de que a decisão do Presidente da Câmara (e a sua omissão em proferi-la) possui natureza predominantemente política e não é passível de revisão judicial, posição que enfraquece a proteção constitucional e o Estado de Direito. O artigo sustenta que o impeachment, embora envolva órgãos políticos, configura um processo jurídico de responsabilização por violações graves da ordem constitucional, exigindo a observância da legalidade, do devido processo legal e da garantia de acesso à justiça. Assim, o controle judicial de omissões ou rejeições arbitrárias pelo Presidente da Câmara revela-se essencial para assegurar a supremacia da Constituição e a preservação da democracia.
