Sumario:This article deals with the analysis of the justification for the application of punitive damages in Argentine law. Based on the claim that any measure that involves state coercion and limiting the scope of freedom of individuals must be properly justified, it is pretended to find the underlying justification in the doctrine and jurisprudence about punitive damages in Argentina to delimit the ideas involved and the consequences that are derived from it, in order to clarify this legal figure that is in a twilight zone in argentine private law.
