Sumario:The present work focuses on the consideration of some substantive principles that play a primary role both in the context of multilateral trade and in the international investment sector. Specifically, the principle of proportionality represents a fundamental tool in the national legal systems and in many international contexts for balancing competing rights and interests. This qualification, including the assessment of the intensity of the investigation conducted by the bodies involved in the resolution of the dispute which forms an integral part of it, leads us to question the configurability not only of a role for the principle of proportionality within the two systems considered, but in particular also of a correspondence between them, in its interpretation and concrete application
