The purpose of this work is to demonstrate that housing constitutes a complex legal institution that has a three-dimensional impact on the law of old age. Methodology. From the methodology of theTrialist theory of the legal world developed by Goldschmidt and Ciuro Caldani, housing can be understood as a material, symbolic and functional object of study. The material dimension alludes to the closed and covered space in which each person establishes his or her center of life, which we will call "home" here. The symbolic dimension refers to the affective and biographical meanings that the house represents for the person who lives in it. It is, therefore, the "home". Finally, housing has a functional dimension from which the development of life is organized and conditioned, so that housing is also a "habitat". Results. The relationship between older people and their home is uniquely critical and dynamic in all three dimensions (home-home-habitat) because of the evolution of old age itself. The following pages are intended to recognize these problems in the light of the law of old age and to provide a legal diagnosis of the challenges and remedies. Objetivo principal. Este trabajo tiene como propósito demostrar que la vivienda constituye una institución jurídica compleja que impacta de manera tridimensional en el derecho de la vejez. Metodología. Desde la metodología de lateoría trialista del mundo jurídico desarrollada por Goldschmidt y Ciuro Caldani, la vivienda puede ser comprendida como un objeto de estudio material, simbólico y funcional. La dimensión material alude al espacio cerrado y cubierto en el cual cada persona establece su centro de vida, que aquí llamaremos "casa". La dimensión simbólica hace referencia a las significaciones afectivas y biográficas que la vivienda representa para quien la mora. Es, pues, el "hogar". Por último, la vivienda cuenta con una dimensión funcional desde la cual se organiza y acondiciona el desarrollo de la vida, de modo tal que la vivienda es también, un "hábitat". Resultados. La relación de las personas mayores con su vivienda resulta singularmente crítica y dinámica en sus tres dimensiones (casa-hogar-hábitat) a causa de la evolución misma de la vejez. Las páginas que siguen están destinadas al reconocimiento de estas problemáticas a la luz del derecho de la vejez y plantea un diagnóstico jurídico acerca de los desafíos y remedios.
