This paper offers a systematic study on legal status of these institutions, as well as about the legal condition of the elderly who live there. It shows a historical perspective that realizes its evolution in Western culture and it develops a legal analysis of the legislation, social relationships and values (justice, utility and truth) referred to Elderly housing and their residents. Guidelines for future legislation are proposed too. Among others, this paper highlights: consider “old age” as an important criterion for positive differentiation in our legal system in order to respect their status in terms of real equality. Ensuring the contractual nature of the legal relationship between each resident and the institution and respecting the exercise of freedom of choice of the elders. Avoid hospitalizations against the will of old people, legally capable. Preserve their rights to identity, physical and moral integrity, the enjoyment of decent housing and health rights. Guarantee their rights to privacy and reputation. Affirm the exercise of their rights to property, in terms of its heritage and its own body. Incorporate living wills and informed consent in Elderly housing contracts. En la actualidad, las residencias gerontológicas constituyen una alternativa adoptada por la familia, la sociedad y el Estado frente a la necesidad de alojamiento, cuidados y, en algunos casos, asistencia sanitaria, que requieren las personas mayores, de manera creciente. En este trabajo, se realiza un estudio sistemático relativo a la condición jurídica de estas instituciones, tanto como, a la de los ancianos que viven en ellas. Se plantea una perspectiva histórica que da cuenta de su evolución en la cultura occidental y luego se realiza un análisis jurídico de los aspectos normativos, sociológicos y valorativos en el marco del derecho nacional y provincial de la República Argentina. Se proponen pautas para una futura legislación en la materia. Entre otras: considerar a la vejez como un dato diferenciador relevante para nuestro sistema jurídico en aras de lograr el respeto cierto de su condición en términos de igualdad ante la ley. Garantizar el carácter contractual de la relación jurídica del residente con la institución y el ejercicio de las libertades de los mayores, evitando internaciones no queridas por sujetos lúcidos. Preservar su derecho a identidad, a la integridad física y moral, el goce de una vivienda digna y sus derechos sanitarios. Asegurar su derecho a la intimidad y a la propia imagen. Afirmar el ejercicio de su derecho de propiedad, tanto respecto de su patrimonio como de su propio cuerpo. Incorporar las disposiciones anticipadas y el consentimiento informado en los contratos celebrados en este ámbito.
